What is a Special Power of Attorney (SPA)?

A Special Power of Attorney (SPA) is a limited legal instrument through which a property owner (principal) authorises another person (agent) to perform one or a few specifically defined acts on their behalf unlike a General Power of Attorney (GPA) which confers broad authority. The scope of an SPA is narrow and precisely defined in the document.

Common SPAs in Real Estate

  • SPA for registration: Authorises agent to attend and register a specific sale deed on the principal's behalf.
  • SPA for loan: Authorises agent to complete loan documentation with a bank.
  • SPA for possession: Authorises agent to accept possession of a specific property.
  • SPA for rental: Authorises agent to lease a specific property and collect rent.

SPA vs. GPA

  • GPA: Broad authority multiple acts, multiple properties.
  • SPA: Narrow authority one specific act, one specific property.
  • Risk: SPA carries lower risk of misuse; GPA carries broader risk if misused.

An SPA is the preferred form of authorisation for specific real estate transactions — minimising the scope of the agent's authority to the exact act required. Whenever a GPA can be replaced with an SPA for a specific transaction, the SPA is the safer and more appropriate legal instrument.
