What is inclusive zoning in real estate?

Inclusive zoning (also called inclusionary zoning) is a land use regulation that requires or incentivizes developers to include a specified percentage of affordable housing units within new residential developments, as a condition for receiving building approvals or development permissions.

How Inclusive Zoning Works

• A city or state mandates that 10–20% of units in any new residential project above a threshold size must be affordable to EWS/LIG households
• Developers may be offered density bonuses, FSI incentives, or tax benefits in exchange for compliance
• Affordable units must be integrated within the project not built separately in distant locations
• Price caps are set by the government typically 25–40% below market rate for the area

Inclusionary Zoning in India

• Not yet uniformly mandated at the national level
• Several states have de facto inclusionary requirements through PMAY and SRA schemes
• MoHUA's model building bylaws encourage inclusionary provisions
• RERA requires developers to disclose affordable unit commitments
• Some municipal corporations (Pune, Bengaluru) have begun experimenting with inclusionary requirements

Inclusive zoning has the potential to be India's most powerful tool for creating economically integrated cities but only if backed by strong enforcement, genuine developer incentives, and clear beneficiary frameworks. Without these, it risks becoming another policy that exists on paper while urban economic segregation deepens on the ground.
