What is the difference between RERA and consumer court?

Both RERA and consumer courts offer remedies to homebuyers aggrieved by developer violations but they operate under different legal frameworks, have different jurisdictions, and offer different types of relief. Understanding the distinction helps buyers choose the most appropriate forum for their specific grievance.

RERA Authority

• Governed by the Real Estate Act, 2016.
• Adjudicates: Project delays, carpet area discrepancies, escrow violations, non-registration.
• Relief: Possession direction, interest on delay, financial penalty on developer.
• Time limit: Orders within 60 days of complaint.
• Jurisdiction: Only for RERA-registered projects.

Consumer Court (Consumer Commission)

• Governed by the Consumer Protection Act, 2019.
• Adjudicates: Deficiency of service defects, delay, misrepresentation.
• Relief: Compensation, refund, mental harassment damages, litigation costs.
• Jurisdiction: Based on complaint value District, State, or National Commission.
• Also covers pre-RERA projects and unregistered developers.

RERA is the preferred and faster forum for most housing complaints in India particularly for delay, carpet area, and financial default issues on registered projects. Consumer courts offer a broader remedy toolkit including mental harassment compensation and are more suitable for pre-RERA projects or where comprehensive damages are sought.
