What properties can NRIs buy in India?

Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) holding foreign citizenship have significant freedoms to invest in Indian real estate under FEMA regulations — with some specific restrictions on certain property types.

Properties NRIs CAN Purchase

  • Residential properties apartments, houses, villas, bungalows.
  • Commercial properties offices, shops, warehouses, commercial plots.
  • Plots for residential or commercial construction (in approved layouts).
  • Under-construction properties from RERA-registered developers.

Properties NRIs CANNOT Purchase (Without RBI Approval)

  • Agricultural land.
  • Plantation property (tea, coffee, rubber estates).
  • Farmhouses.

NRIs have broad freedom to invest in Indian residential and commercial real estate the restrictions are limited to agricultural, plantation, and farmhouse categories. The key to compliant NRI property investment is routing all payments through appropriate bank accounts and maintaining complete documentation of fund sources.
